PUBLIC OFFER AGREEMENT

This document is an official public offer in accordance with Articles 633 and 641 of the Civil Code of Ukraine and the Law of Ukraine “On Electronic Commerce”. It regulates the relationship between the Seller and the Buyer in the distance sale of goods.

1. General Provisions

1.1. This Agreement is a public agreement, the terms of which are the same for all Buyers.
1.2. The Seller sells goods through the Tabix brand website.
1.3. Acceptance of this offer is the placement and full payment of an order by the Buyer on the Website.
1.4. From the moment of payment, the Agreement is considered concluded.

2. Terms and Definitions

Seller — Individual Entrepreneur Styba Oleksandr Anatoliiovych, Tabix brand.

Buyer — an individual who places an order on the Website.

Website — the website through which Tabix products are sold.

Product — products presented on the Website.

Order — a completed request by the Buyer to purchase a product.

The provisions of this Agreement apply together with the Privacy Policy published on the Website.

3. Order Placement Procedure

3.1. The Buyer independently places an order on the Website by selecting a product and filling in the contact details.
3.2. After placing the order, the Buyer makes payment through the Portmone payment service.
3.3. After successful payment, the order is considered accepted for processing by the Seller.

4. Rights and Obligations of the Parties

4.1. The Seller undertakes to:

provide accurate information about the product;

deliver a product of proper quality;

comply with the terms of this Agreement.

4.2. The Buyer undertakes to:

provide correct contact details;

pay for the order in full;

accept the product in accordance with the delivery terms.

5. Prices and Payment Procedure

5.1. Product prices are indicated on the Website in the national currency of Ukraine.
5.2. The valid price is the price indicated at the time of placing the order.
5.3. Payment is made online through the Portmone payment service using Visa and MasterCard payment cards.
5.4. The Portmone payment system is not used for partial or advance payments.
5.5. In the case of successful payment, the payment system considers the funds to have been paid in full.

6. Delivery and Transfer of Goods

6.1. Delivery of goods is carried out within the territory of Ukraine.
6.2. The cost and delivery terms are indicated during the order placement process.
6.3. The Buyer must check the product for integrity and completeness upon receipt.

7. Product Returns

7.1. The Buyer has the right to return a product of proper quality within 14 calendar days from the date of receipt, in accordance with the Law of Ukraine “On Consumer Protection”.
7.2. To make a return, the Buyer must contact the Seller using the contact details indicated on the Website.
7.3. The product must be in saleable condition, without signs of use, and in full комплектation.
7.4. Products made according to the Buyer’s individual order are not subject to return.

8. Refunds

8.1. Refunds are made after the returned product has been received and inspected.
8.2. If payment was made by bank card, the funds are refunded using the same payment method that was used for the payment.
8.3. The refund period is up to 10 banking days or up to 14 calendar days from the moment the return is confirmed.

9. Refunds in Case of Mistaken or Duplicate Payment

9.1. In case of mistaken or duplicate payment, the Buyer has the right to contact the Seller.
9.2. After confirming the fact of mistaken or duplicate payment, the funds are refunded using the same payment method that was used for the payment, within the terms specified in this Agreement.

10. Confidentiality and Personal Data Protection

10.1. Personal data is processed in accordance with the legislation of Ukraine.
10.2. Detailed terms for the processing of personal data are set out in the Privacy Policy published on the Website.

11. Force Majeure

11.1. The Parties are released from liability for non-performance of obligations in the event of force majeure circumstances, including war, natural disasters, technical failures, etc.

12. Term of the Agreement

12.1. This Agreement is valid from the moment of acceptance and until the Parties have fully fulfilled their obligations.

13. Dispute Resolution

13.1. Disputes are resolved through negotiations.
13.2. If no agreement is reached, the dispute shall be resolved in court in accordance with the legislation of Ukraine.

15. Final Provisions

15.1. The Seller has the right to change the terms of this Agreement by publishing a new version on the Website.
15.2. The electronic form of the Agreement has the same legal force as a written agreement
